Cleveland: 12-Year-Old Tamir Rice Caused His Own Shooting Death by Failing to ‘Avoid Injury’

A report obtained by Buzzfeed has found that the city of Cleveland is claiming that 12-year-old Tamir Rice, who was shot dead by a police officer late last year, caused his own death.

In November, Rice was fatally shot by rookie police Officer Timothy Loehmann while playing with a replica gun.

Footage from the park where Rice was shot shows Loehmann and his partner start shooting at Rice within two seconds of arriving.

In their statements to investigators, the officers said that Rice was with a group of boys waving the gun around, though the footage later disproved that.

Despite all that, the city is not budging.

After two separate investigations, the city responded to a lawsuit by Rice’s family, claiming the boy’s death was his own fault.

“Plaintiffs’ decedent’s injuries, losses, and damages complained of, were directly and proximately caused by the failure of Plaintiffs’ decedent to exercise due care to avoid injury,” the city’s statement said. “Plaintiffs’ injuries, losses, and damages complained of, were directly and proximately caused by their own acts, not this Defendant.”
